with the act of March twelve, 1870, the burgess and city council were authorized to levy a street tax not exceeding ten rather than 5 mills, as supplied by the act of March fifteen, 1848, to be a Road tax, and necessary home-owners to pave their sidewalks fronting on all streets with brick or stone; and in the event that they neglect or refuse to d
